Car Accidents in New Jersey

Losing a loved one is an incredibly difficult experience to endure, especially when it happens unexpectedly in a fatal car accident. Sadly, there are hundreds of fatal accidents reported statewide every year, many of which involve innocent people losing their lives as a result of the negligence of others.

If your loved one has tragically passed away in a fatal collision, taking legal action becomes crucial. Contacting a wrongful death lawyer in Toms River is in your family’s best chance of holding the responsible party accountable for the loss.

Under the wrongful death statute in New Jersey, the personal representative of the deceased individual is responsible for initiating legal proceedings following a fatal car accident. In most cases, this representative is the executor or administrator of the deceased person’s estate.

However, if the decedent did not have an estate, the court could appoint a personal representative to pursue the wrongful death claim on their behalf. It is important to note that a claim for wrongful death must be filed within two years of the passing of the decedent.

Filing a wrongful death claim can provide your family with compensation for funeral arrangements, burial expenses, lost earning capacity, and more. Although you have a two-year period to file the claim, it is advisable to take immediate legal action to gather strong evidence and support for your case.
