Individuals generally may consult with and be represented by an attorney whenever they choose. The relationship is created by an agreement that the client will pay a fee in exchange for certain services to be provided by the attorney. When an individual hires or retains a particular attorney, and the attorney agrees to represent that individual, an attorney/client relationship is created. The client will be responsible for paying attorney’s fees as set forth in the retainer or fee agreement. In cases involving a claim for personal injury, the client’s responsibility to pay a fee to Garces, Grabler & LeBrocq is contingent on a monetary recovery – no recovery, no fee.

The attorney’s primary task is to protect the client’s legal rights and to serve as an objective legal advisor. Attorneys must use their best efforts on behalf of their clients, but they cannot guarantee particular results in cases. The attorney should keep his or her client informed of the status of the client’s legal problem, and should provide copies of all correspondence and documents prepared on the client’s behalf or received from another party. An attorney may not settle the client’s case without the prior approval of the client. An attorney’s conduct must comply with the New Jersey Rules of Professional Conduct.

No, New Jersey is not a community property state. New Jersey is classified as a common law state. The difference between common law and community property systems centers around the property rights possessed by married persons. In a common law system, each spouse owns whatever he or she earns. Under a community property system, one-half of the earnings of each spouse is considered by the other spouse.

Notify the police, exchange information with the other driver, take photos of the scene, and seek medical attention right away. Acting quickly helps protect your rights and speeds up your insurance claim.

New Jersey is a no-fault state. This means your own auto insurance covers your medical expenses and lost wages (called Personal Injury Protection or PIP) regardless of who caused the accident.

PIP covers:

  • You (the policyholder)
  • Members of your household
  • Step- or foster children
  • Passengers or pedestrians injured in the accident

You can still get medical treatment. Call your auto insurance company and request a claim number for your injuries. You can use this number to see doctors that accept PIP coverage.

If you need help finding a provider, our team can assist you.

You may still be covered by the driver’s PIP or a family member’s policy in your household. Our office can help determine which policy applies to you.

Your PIP coverage details are listed on the Declarations Page of your insurance policy. If you’re unsure how to interpret it, our attorneys can review it with you.

You generally have two years from the date of the accident to file a claim. Once a case is settled, it cannot be reopened.

Your Uninsured Motorist Coverage (UMC) may cover medical expenses and property damage if the at-fault driver doesn’t have insurance.

You can still pursue a claim if the accident aggravated your pre-existing condition. Our attorneys can help gather medical documentation to prove this.

We work on a contingency fee basis — meaning you don’t pay anything upfront. We only get paid if we win or settle your case.

Every case is different, but most are resolved within several months to two years, depending on complexity and negotiations.

Have your police report, medical records, insurance information, photos of the scene or vehicle, and any notes about the accident ready. These help us assist you faster and build a strong case.

Notify your employer right away and document the incident. Request medical treatment through your employer’s workers’ compensation insurance.

Yes. New Jersey law requires all employers (except those covered by federal programs) to carry workers’ compensation insurance or be approved for self-insurance.

➡️ If your employer does not have the required insurance, contact our team at Garces, Grabler & LeBrocq immediately. We can help you understand your rights and explore legal options to recover your benefits.

Your employer should file a workers’ compensation claim for you.

You must receive treatment from authorized doctors within the workers’ comp network.

All approved medical expenses will be covered through the insurance carrier.

No — unless it’s an emergency and no approved workers’ comp doctor is immediately available. Otherwise, your treatment should go through your employer’s workers’ compensation coverage.

You have two years from the date of your injury or from your last authorized medical treatment to file a formal claim.

If you miss more than seven days and your workers’ compensation doctor approves your time off, you may receive temporary compensation benefits, which typically cover up to 70% of your regular wages.

Yes. All workers — regardless of immigration status — are protected under New Jersey law. You have the right to medical treatment and wage benefits. Employers cannot retaliate against you for filing a claim.

Yes. You can reopen your case within two years of your last benefits payment, unless it was settled under a Section 20 lump-sum agreement, which fully closes the case.

You must generally see a doctor authorized by your employer’s insurance. However, if you’re unsatisfied, you can request a second opinion or a new doctor with approval.

Contact an attorney immediately. Our team can help you appeal, gather the right documentation, and ensure your rights are protected.

Have your incident report, medical records, recent pay stub, any correspondence with your employer or insurer, and related documents ready. These help us evaluate your case quickly and accurately.
