Talc is a natural mineral that can be found in products like baby powder, cosmetics, and even some foods. In recent years, lawsuits have been filed against companies that make talc products because of claims that long-term use has led to serious health conditions like cancer, lung irritation and breathing difficulties, and gynecological problems.
Johnson & Johnson, a manufacturer of products containing talc, has attempted to suppress many current lawsuits by moving its talc liabilities into a new company called LTL Management, which subsequently filed for bankruptcy protection.
This is a well-known tactic employed by companies facing lawsuits that are trying to limit their responsibility and deny plaintiffs their right to a jury trial. Fortunately, the judicial system views such actions very skeptically, and federal judges have dismissed Johnson & Johnson’s bankruptcy claims twice, most recently in July.
This means the nearly $10 billion settlement will have to be paid out to plaintiffs.
