How Can Families Prove a Driver Was Negligent in a Deadly Pedestrian Accident in New Jersey?
Families can prove negligence by obtaining the New Jersey police crash report. This document explains how the collision occurred, including traffic signals, right of way, vehicle positions, and citations. The report supports a wrongful death claim.
Camera footage can show what happened before and during the impact. Nearby business surveillance systems or traffic cameras may capture signal timing and driver behavior. Early requests help preserve recordings before they are erased.
Witness statements describe what people observed in real time. Names and contact information help preserve accurate accounts. Written or recorded statements can support other documentation.
Medical and autopsy records link the fatal injuries to the crash. These documents describe trauma patterns and confirm the official cause of death. They show how the impact led to the loss of life.
A wrongful death attorney can review crash records to determine whether the driver failed to meet the required duty of care. A lawyer can also explain how fault is determined under state law and what compensation may be available to eligible family members.
