Who Can File a Wrongful Death Claim in New Jersey?
In New Jersey, wrongful death claims are typically brought by the executor or administrator of the deceased person’s estate on behalf of eligible beneficiaries. Those beneficiaries often include the surviving spouse, children, or other dependents, such as parents, who relied on the deceased for financial or household support.
These claims are intended to help families recover compensation for the financial and emotional losses resulting from the death of a loved one caused by another party’s negligence.
The court may distribute any recovery based on each beneficiary’s level of dependence on the deceased.
Compensation in a wrongful death claim may include:
- Funeral and burial expenses
- Loss of financial support
- Loss of services and household contributions
- Loss of companionship, care, and guidance
In some cases, families may also pursue a separate survival action to recover damages the victim may have been entitled to before death, such as medical expenses, lost income, and pain and suffering.
Because wrongful death cases involve strict filing deadlines and complex legal requirements, families are encouraged to seek legal guidance as early as possible. A wrongful death attorney in Westampton can help determine eligibility, gather evidence, and ensure that all claims are filed in compliance with state law.
