How New Jersey Workers’ Compensation Applies to Industrial Machinery Injuries in Hackensack, NJ
Workers hurt by industrial machinery in New Jersey are generally covered through the state’s workers’ compensation system, regardless of who was at fault for the accident.
This no-fault structure means an injured worker does not need to prove the employer was negligent to receive benefits, which can include medical treatment, a portion of lost wages, and compensation for any permanent impairment.
Machinery-related injuries typically raise questions that go beyond standard workers’ compensation claims. When a machine itself is found to have a design flaw, a manufacturing defect, or inadequate safety guards, a worker may have a separate claim against the manufacturer or another third party outside the employer.
These product liability claims are distinct from workers’ compensation and can allow for additional types of damages that workers’ compensation does not cover.
When OSHA is involved, it can shape how a claim develops. Workplace safety investigations can produce documentation, such as inspection findings and safety violation citations, that may become relevant to a workers’ compensation claim or a separate third-party case.
It is important to preserve records about the machine’s maintenance history, safety features, and any prior complaints can matter a great deal, since this kind of evidence can become harder to obtain once equipment is repaired or replaced.
A work injury accident lawyer can help evaluate whether a third-party claim may exist alongside a workers’ compensation claim and can assist with gathering this evidence before it is lost.
