How Does Insurance Work After a Pedestrian Accident in Aberdeen Township, NJ?

After a pedestrian is struck by a vehicle in New Jersey, understanding how insurance applies to the situation is one of the most important early steps a family can take. New Jersey is a no-fault insurance state, which means that certain medical expenses are typically covered by the driver’s personal injury protection coverage regardless of who caused the crash.

However, when a pedestrian is killed or suffers serious injuries, the no-fault system may not be the only avenue available. Families may also be able to pursue a claim directly against the at-fault driver’s liability insurance, depending on the circumstances involved.

When a fatal crash occurs in a marked crosswalk, the driver’s liability coverage becomes particularly relevant. New Jersey requires drivers to carry minimum liability insurance, but the costs associated with a fatal crash, including funeral expenses, lost income, and a wrongful death claim, can exceed standard policy limits. In those situations, additional avenues such as underinsured motorist coverage may be worth exploring with the help of an attorney.

An attorney may be able to help surviving family members navigate the insurance process following a fatal pedestrian crash. This includes identifying all applicable coverage, understanding how New Jersey’s no-fault rules interact with a potential liability claim, and ensuring that insurance companies do not settle for amounts that fall short of what the family may be entitled to pursue.

wrongful death lawyer can help families understand their rights, ensure deadlines are met, and advocate for maximum compensation.
