What Damages Are Available in a Fatal Accident Case in E Orange?
When a fatal accident occurs, families are often left facing both emotional grief and financial uncertainty. In Essex County, New Jersey, the law allows certain surviving family members to pursue compensation through a wrongful death claim.
While no amount of money can replace a loved one, these damages can help ease the financial impact and provide stability moving forward.
One of the main categories is economic damages, which cover the financial losses connected to the accident. This includes the cost of medical care provided before the victim’s passing, as well as funeral and burial expenses.
Families may also recover the income the deceased would have earned over time, along with lost benefits such as health insurance or retirement contributions. These damages are intended to reduce the economic burden that often follows an unexpected loss.
In addition, families may be entitled to non-economic damages, which reflect the emotional and personal impact of the tragedy. This can include the loss of companionship, care, and guidance that the deceased would have provided. For families with children, the loss of parental support is especially significant.
Courts also recognize the emotional suffering and grief experienced by surviving loved ones, even though these losses are not tied to a specific dollar amount.
Another important component is the survival action. This type of claim focuses on what the victim experienced between the time of the accident and their passing. Compensation may be available for the pain and suffering they endured and for any medical expenses incurred during that period.
Understanding what damages are available in a fatal accident case in East Orange can help families make informed decisions during a very difficult time. These claims are not only about financial recovery, but they also serve to hold responsible parties accountable and help families begin to move forward.
A wrongful death lawyer can help families understand their rights, ensure deadlines are met, and advocate for maximum compensation.
