Compensation in Fatal Accidents in New Jersey
Fatal motor vehicle accidents
can leave families facing overwhelming emotional and financial challenges. In New Jersey, surviving family members may be eligible to pursue compensation through a wrongful death claim when a loved one is killed due to another party’s negligence.
Compensation in these cases may include:
- Funeral and burial expenses: Coverage for end-of-life costs, including funeral services, burial or cremation fees, memorial arrangements, transportation, and related administrative expenses that families often face immediately after a loss.
- Medical expenses: Reimbursement for emergency treatment provided before death, such as ambulance transport, hospital care, surgical intervention, medication, and other life-saving efforts made before the victim passed away.
- Loss of financial support: Compensation for the income, wages, benefits, and retirement contributions the deceased would have reasonably provided to their family over their expected lifetime.
- Loss of services: The value of household support and care provided by the victim, including childcare, home maintenance, caregiving, and other essential daily contributions.
- Loss of companionship, guidance, and consortium: Damages recognizing the emotional, relational, and moral support lost by surviving spouses, children, and dependents.
- Pain and suffering: Compensation for the victim’s conscious pain, emotional distress, and physical suffering experienced before death, when applicable.
While New Jersey operates under a no-fault insurance system, wrongful death claims often allow families to pursue additional compensation from the at-fault party, particularly in cases involving commercial vehicles.
