Motorcycle Accidents in New Jersey

Due to the very nature of accidents involving motorcyclists, victims are more likely to suffer serious injuries that affect their lives forever. Unlike motorists who are traveling inside sedans, SUVs, and even compact vehicles, motorcyclists do not have anything surrounding their bodies to protect them. As a result, they are at an increased risk of suffering blunt force injuries and being ejected from their vehicles.

After a motorcycle accident, victims have the ability to pursue legal claims against the responsible party. In New Jersey, personal injury claims are paid to victims based on the comparative negligence doctrine. This tort principle states that the amount of compensation a victim is able to recover for their personal injury lawsuit will be reduced in proportion to the fault that they shared for the crash. In other words, if you were injured as a result of a motorcycle accident, and you were found to be 25 percent at fault for the accident taking place, the amount of compensation that you are able to recover will be reduced by a total of 25 percent.

Insurance companies in our state are well aware of the comparable negligence laws that we have in place. As a result, they tend to do everything in their power to shift the blame onto victims in order to reduce the amount of money they pay. This makes it important for you to seek guidance from a Toms River motorcycle accident lawyer immediately after your accident. Your attorney will be able to gather evidence on your behalf against the defendant in order to prove that they shared most or all of the fault for the accident taking place.
