Compensation Available After a Fatal Crash in Moorestown, NJ
When a pedestrian is killed in a crash, surviving family members may have the right to pursue several types of compensation. These include funeral costs, lost income, pain and suffering, and loss of companionship. Each category addresses a different financial or personal impact of the loss.
Among the most immediate concerns after a fatal accident are funeral and burial expenses. These costs are often recoverable through a wrongful death claim in New Jersey. Families may seek reimbursement for services, burial plots, and related arrangements.
Beyond immediate expenses, a fatal crash can also affect a household’s primary or secondary source of income. Surviving family members may pursue compensation for wages the victim would have earned. Future earning potential and benefits are also considered in these claims.
New Jersey law also allows certain claims for the pain and suffering a victim experienced before death. These damages reflect conscious harm endured during or after the collision. They are evaluated separately from economic losses in a wrongful death case.
Loss of companionship recognizes the emotional and relational impact on surviving family members. Spouses, children, and dependents may each have standing to pursue this type of claim. Courts consider the nature and closeness of each relationship.
Even when families have a valid claim, insurance companies may dispute liability or limit payouts. Policies sometimes carry coverage limits that fall short of a family’s actual losses. Handling these disputes without legal guidance can affect what a family recovers.
A New Jersey wrongful death lawyer can investigate the crash, gather evidence, and identify all liable parties. Legal representation also helps families avoid mistakes that could reduce or bar recovery.
